Supreme Court takes up TULF interim injunction case

The three member bench of the Supreme Court chaired by Chief Justice Sarath N.Silva fixed the inquiry for August 25 into the appeal filed by the Secretary General and Senior Vice President of the Tamil United Liberation Front (TULF) Messrs R.Sampanthan and Jospeh Pararajasingham against the interim order issued by the Colombo District Court and later affirmed by the Court of Appeal preventing them from summoning the central committee of the TULF without the consent of the President Mr. V.Anandasangaree, legal sources said.

The other two members of the SC bench are Justices Asoka de Silva and Nihal Jayasinghe.

The Colombo District Court issued an interim order on February 11 this year on the application filed by Mr.Anandasangaree against summoning the central working committee meeting of the TULF without his consent. Mr.Sampanthan and Joseph Pararajasingham who have cited as respondents filed an appeal in the Court of Appeal seeking to quash the interim order.

However the Court of Appeal affirmed the interim order.

Thereafter, Messrs Sampanthan and Joseph Pararajasingham filed an appeal against the order of the Court of Appeal in the Supreme Court. Both petitioners cited Mr.Anandasangaree as the respondent. Petitioners have sought the Supreme Court to set aside the order made by the District Court and later affirmed by the Court of Appeal that they have been prevented from summoning the central working committee thus causing difficulties for them to pursue political activities of the party.

President Counsel S.Sivarasa with Attorneys M.A.Sumenthiran, A.Selvaretnam and S.Pirapaharan instructed by Attorney Mohan Balendra appeared for the petitioners. President Counsel Wijedasa Rajapakse appeared for Mr.V.Anandasangaree.
