Court extends interim injunction on P-TOMS

Sri Lanka's Supreme Court Monday extended its interim injunction on the
implementation of certain clauses of the Pre-Tsunami Operational Management
Structure (P-TOMS) till November 22 and fixed the inquiry into the petition
filed by the Janatha Vimukthi Peramuna (JVP) seeking the cancellation of
the P-TOMS on the same date, legal sources said.
The Supreme Court in July issued interim injunction on the implementation
of certain clauses of the P-TOMS including the establishment of its
headquarters in Killinochchi on the JVP petition and put off the further
inquiry for September 12. When the JVP petition along with five other petitions came up for inquiry
against the P-TOMS agreement on Monday, counsel for the first respondent
Mr.M.S.Jayasinghe, Secretary of Reconciliation, Rehabilitation and
Reconstruction ( RRR) Ministry submitted to court that the government is
unable to implement the P-TOMS agreement signed with the Liberation Tigers
of Tamil Eelam (LTTE) because of the interim injunction of the Supreme
Court. The Counsel further submitted to court that the government is unable
to obtain any assistance from various countries for the implementation of
tsunami relief and rehabilitation projects due to the non-functioning of
the P-TOMS, legal sources said. Chief Justice Mr.Sarath N.Silva interrupted and said that there is no
obstruction to implement the P-TOMS subject to interim injunction order on
certain clauses issued by the court, legal sources said. The JVP in its petition cited RRR Ministry Secretary Mr.Jayasinghe,
LTTE Planning Deputy Head Mr.Ranjan and the Attorney General as
respondents.
