LTTE leader served notice through the media in MoU case

The Court of Appeal of Sri Lanka Wednesday served notice by newspaper publication on the leader of the Liberation Tigers of Tamil Eelam, Mr.V.Pirapaharan, the second respondent in cases filed separately by the Sinhala Jathika Sangamaya, the Janatha Vimukthi Peramuna and the Sihala Urumaya, who challenged the Memorandum of Understanding signed by the Government of Sri Lanka (GOSL) and the LTTE on 22nd February 2002 on the grounds that it was “illegal and unconstitutional,” legal sources said

Three petitioners, Dr. Piyasena Dissanayake of the SJS, Mr.Thilak Karunaratne of the SU and Mr.Tilvin Silva of the JVP, have cited 26 respondents in their application for Writ of Certiorari and/or Prohibition under Article 140 of the Constitution, filed separately, legal sources said.

The first respondent is the Prime Minister of Sri Lanka, Mr.Ranil Wickremasinghe, the second is Mr.Pirapaharan, the third to twenty fifth are cabinet ministers and the 26th respondent is the Attorney General, legal sources said.

During earlier dates at the court, all the respondents in these cases were represented in court except the LTTE leader. The petitioners thereafter made an application to serve notice on the second respondent by publication in newspapers. When these cases were taken up for inquiry on February 19 this year, the Court accepted the application and said that Notice would be given by publication in Newspapers. The Court further ordered that the proof of the publication of the Notice on the second respondent to appear in court be shown on August 8 this year.

Accordingly, English, Tamil and Sinhala daily newspapers of the State-run Lake House, the Daily News, Thinakaran and Dinamina, carried the Notice in their Wednesday issues. The Registrar of the Court of Appeals, Ms M.M. Jayasekara, has signed the Notices.
