"Sri Lanka's Judiciary consistently denied justice to Tamils" - Thamilchelvan[TamilNet, Tuesday, 26 July 2005, 15:21 GMT]"We have seen how the Judiciary of Sri Lanka aided the oppression of Tamil people during the period of war, and we have recently witnessed how Colombo's Supreme Court crippled the Agreement on Joint Mechanism accepted by the President of Sri Lanka," LTTE's Political Head Mr. S. P. Thamilchelvan said in his key note address delivered in Kilinochchi at the ceremony to mark the opening of the new building for Legislation Secretariat of the Judicial Administrative Unit of the Tamil Eelam on Tuesday. "The Sinhala Nation has failed to seize the opportunity during this three and a half year period of absence of war to resolve the Tamil national question," LTTE's Political Head said. Mr. E. Pararajasingham (Para), head of the Judicial Division of the Liberation Tigers, presided the event. Mr.P.Nadesan, head of Thamil Eelam Police, LTTE's Senior Member Mr. K. V. Balakumaran and Head of the Thamileelam Martyrs Department Mr. Pon Thiyagam also participated in the event. Translated extracts from the keynote speech delivered by Mr. Thamilchelvan follow: "The Srilankan Judiciary's entire history is one of denying justice to the Tamils." "Sinhala chauvinists did not rush to courts over the question of Cease Fire Agreement [CFA], however they did it over the P-TOMS. "The reason for not taking the former to courts is the realization that CFA was an agreement between two Armed Forces of equal might. The Sinhala Nation would have faced a disaster if CFA had been taken to Sri Lankan Supreme Court." "The recent decision by the Supreme Court is viewed by us as one that has crippled an agreement accepted by the executive President of Sri Lanka". "This agreement was placed before us by the International Community for humanitarian reasons and in good faith, leaving aside contentious political issues. "However, Colombo has dragged this vital matter for six months and at the end gave its sanction to help resolve the internal contradictions within the [UPFA] alliance government. This was a well orchestrated manoeuvre." "Supreme Court stated that no one should prevent the use of executive power for the benefit of the nation. However, Court has imposed a restraint on the full implementation of the joint mechanism. "The Sri Lanka's President and the Judiciary have jointly created this situation." "The Judgment helps to preserve the political status of the President and to save her from the wrath of the Sinhala Society." "The International Community has now realized this." "Ms Kumaratunge tells the International Community a fairy tale. She says that her Government has no link with the paramilitary groups. This is laughable. The International Community is fully aware of the links between the Sri Lankan Forces and the paramilitary groups." "The opening of this Secretariat is a matter of pride for the Tamils. The Sinhala Nation's legislature has always aided oppression of our people." "The depth of our National Leader's concern for the liberation of our homeland extends in equal measure to the independence and well being of our people. He has helped to create a cohesive and integrated structure to the liberated lands and has setup an effective and well knit administrative unit," said Thamilchelvan.
