UN Sri Lanka tribunal will avoid ICC jurisdictional issues, says Boyle

The United Nations General Assembly (GA) must immediately establish an International Criminal Tribunal for Sri Lanka (ICTSL) as a "subsidiary organ" under U.N. Charter Article 22, and organized along the lines of the International Criminal Tribunal for Yugoslavia (ICTY), which was established by the Security Council, said Professor Francis Boyle, an expert in International Law, while commenting on the appointment of Samantha Power as the U.S. Ambassador to the United Nations, and advocating that Ms Power should follow the leadership of Madeline Albright who spearheaded the setting up of the ICTY. This will avoid the jurisdictional hurdles in the ICC taking up criminal matters related to a non-signatory state, Boyle added.

The Director of Multilateral Affairs and Human Rights of the U.S. National Security Council, Samantha Power, who has been nominated for U.S. ambassador to the United Nations, has been attending a Senate hearing on the nomination this week where she has been forcefully advocating action to stop “the grotesque atrocities being carried out by the Assad regime,” Washington media reported. Professor Boyle, pointing out Power's conspicuous silence during the killing of Tamil civilians reaching genocidal proportions by the Sri Lanka military, said that Power now has a chance to "redeem" herself by establishing an International Criminal Tribunal for Sri Lanka, as did her predecessor Madeline Albright to the former Yugoslavia.

EU parliamentarians request GoSL to ensure accountability

A delegation of European Union parliamentarians visiting Sri Lanka requested Colombo to “ensure accountability in the face of what the UN calls "credible allegations" of up to 40,000 civilians killed in the final battles in 2009” the AFP reported on Friday. "On the physical side in terms of roads and reconstruction, the progress is very, very visible, but a lot more needs to be done on political issues," the AFQ quoted the delegation head, UK’s Jean Lambert. Ms Lambert had also said that the EU wanted Sri Lanka “to implement recommendations of its own domestic war probe which called for independent investigations into alleged rights abuses.” The “domestic war probe” by the genocide-accused Sri Lankan government has been condemned as a farce by many Tamil political activists.

American feminist writer contrasts gender politics of LTTE and GoSL

“The Sri Lankan government has used rape against Tamil men and women suspected of being members of the LTTE [...] but the Tamil Tigers have seemingly not used it in retaliation,” writes American feminist writer Michele Lent Hirsch. In an article that is general commentary on the use of rape by both state and non-state actors in war published on Women Under Siege on Tuesday, the author compares and contrasts the gender politics of the LTTE with other actors in conflicts, and concludes that “if rape is not inevitable in war, it follows that we have all the more reason to hold the perpetrating groups responsible.” Commenting on this, a Tamil feminist activist from Vanni remarked that it is not only important to condemn rape in war in general, it is also important to recognize the nature of the sexual violence used in specific cases and to deal justice to survivors accordingly.

Sri Lanka bans Time Magazine’s issue on Myanmar Buddhist extremism

The GoSL has banned the Time Magazine’s July 1st edition that had coverage of Buddhist extremism in Myanmar as its cover story. Sri Lankan officials claimed that the issue, which focuses on the anti-Muslim “Buddhist terror” of the 969 Movement in Myanmar led by the monk A. Wirathu, would offend “religious sentiments” in the island. However, progressive media activists from the island questioned why is it that not one international magazine has bothered to cover the several faces of Sinhala ‘Buddhist terror’ that have been collectively responsible for the genocide of the Eezham Tamil nation.

Sinhala leftist criticizing government repression overlooks Tamils’ struggle

The Sri Lankan government’s real concern at the moment is “the threat of widespread social unrest and an uprising by workers, youth and poor”, writes Sinhala leftist K. Ratnayake in article published on the Trotskyite World Socialist Web Site on Monday. Referring largely to Gotabaya Rajapaksa’s “Sri Lanka’s National Security Concerns” lecture at the Kotelawala Defence University in early June, the author claims that “The defence minister’s reference to a renewed “terrorist” threat is aimed at whipping up anti-Tamil communalism to divide the emerging struggles of the working class.” However, an alternative politics Eezham Tamil activist from Jaffna questions whether Mr. Ratnayake, who overlooks the Tamils’ struggle for sovereignty resisting genocidal occupation of their homeland by the GoSL, is consciously or unconsciously defending the state structure that he claims to criticize.

Tamil Nadu protests condemn Indo-Sri Lanka military co-operation

Protests in the Nilgiris district of Tamil Nadu came down sharply on the Indian government for its continued military co-operation with the Sri Lankan military, which is accused not just of the genocide of the Eezham Tamils but also of murdering hundreds of Tamil Nadu fishermen. The protests erupted in the wake of the news that two SL military officers were to be given training at the Defence Services Staff College in Wellington, Nilgiris. While this opposition led to the transfer of the officers to another facility in Andhra Pradesh followed quickly by the GoSL’s recall of the officers, Congress minister E.M. Sudarsana Natchiappan defended India’s military relationship with Sri Lanka, playing the China card.

GoSL’s new media code to further curtail free speech: HRW

Referring to the ‘Code of Media Ethics’ official proposed by Sri Lanka’s Ministry of Mass Media and Information two days back, Human Rights Watch in a release on Wednesday criticised the proposal for its “overbroad and vague language that could have a severe and chilling effect on free speech”. Noting how the proposed code could be used to curtail any dissent to the government and referring to the already existing repression of journalists, HRW reported that “Violence remains a real fear for journalists, which is only heightened by impunity for perpetrators.” Arguing that the vagueness of this code would lead to self-censorship by many journalists, Brad Adams, Asia Director of HRW, also commented that “The code would hand the Sri Lankan authorities a new tool to harass and threaten journalists who are already working in a very difficult environment.”

Genocide could be mandated by democracy of West: Malathy

Malathy, a key member of NESoHR and the author of ‘A Fleeting Moment in My Country’ at a meeting in Auckland, organized by the New Zealand Tamil Society on 5th May. “In this talk I have to convince you that there is nothing surprising in the behaviour of the Western institutions,” Malathy continued substantiating her stand and said that genocide can be mandated by a Western style of democracy. In meeting the situation, Tamils in Tamil Nadu have taken up their own course of action. Tamils in Tamil Eelam would act to suit their own conditions. The best for the diaspora is to protest in numbers as they did in 2009 and protest continuously, Malathy concluded.

UK author eulogising Sri Lanka COIN backfires exposing USA

The latest is a COIN literature on Sri Lanka, ‘Total Destruction of the Tamil Tigers’ by British analyst Paul Moorcraft, which adds to the myth of a ‘successful innovative Sri Lanka COIN’, while covering up the genocide executed by GoSL. But, it exposes the various measures taken by the US-led powers to break the Tamils’ struggle, including advise by the Pacific Command to the GoSL as early as in 2002 to use cluster bombs. When the US-led West's military mindset is such an approval to the SL model, its ‘rights abuses’ talk is just a strategic façade, realize Tamil activists.

Tamil from Australia tortured, abused by Sri Lankan forces during visit to island

An Eezham Tamil male currently residing in Melbourne, Australia was tortured and sexually abused by Sri Lankan forces when he paid a visit to the island a few weeks before, Australian media reports. Speaking under a different name of ‘Kumar’ to the ABC on Wednesday, the father of three described in graphic detail of how he was abducted and tortured. This was, however, flatly rejected as “false allegations” by the SL High Commissioner for Australia, Thisara Samarasinghe, himself a military officer accused of war crimes. Despite living in Australia, the torture survivor is unable to come out in public owing to fear of retaliation by the GoSL on his family back in the island. Tamil sources from Australia further said that as long as the US and its bloc are going to churn out only impotent resolutions, this arrogance of the genocide-accused SL state would continue.

Indian news magazine highlights accelerated Sinhalization of Tamil north

In a commentary on the ‘post-war’ scenario in the northern part of the Tamil homeland in the island of Sri Lanka, a correspondent for The Weekend Leader, a Chennai based online news magazine, highlights the accelerated Sinhalization of the Tamil north through political, social, cultural, economic and military means, giving cases for each. In the article titled ‘Erasing the cultural leftover of Tamils to convert Sri Lanka into Sinhala country’ published on Tuesday, the correspondent writes that the Tamil north “is in the grip of Sinhala hegemony”, adding that Sinhala and Sinhalization are the watchwords in the region. The writer also underscores the vital role that the occupying Sinhala military plays in facilitating this process and how development projects are used as a ruse by the GoSL to further colonize Tamil areas.

NZ Intelligence alleged of monitoring former Green MP for involvement in Tamil question

New Zealand's Security Intelligence Service (SIS), which is part of the so-called Five Eyes intelligence network, comprising the intelligence agencies of Australia, Canada, Britain and the USA, was alleged of monitoring former Green party politician Keith Locke, who has been sympathetic to the Tamil cause. Mr Locke believes the SIS began covert operations on him in 2003, when he travelled to Sri Lanka, reports The Dominion Post. The former Green Party politician has demanded apology for illegal spying and that all 88 New Zealanders who were being spied on should be notified if the Government Communications Security Bureau (GCSB) has illegally snooped on them.
