Cannot expect solutions from NGOs tied to western bureaucracies: Kurdish Activist

Stating that oppressed nations must enforce their own agendas and not rely on NGOs like ICG for solutions, Kurdish activist in UK, Mehmet Aksoy, argued that such NGOs were entrenched in bureaucracies, at a seminar on ‘State Repression and the Struggle for Self-determination: Strategies for Resistance’ organized by Campaign against Criminalising Communities (CAMPACC) on Sunday. The meeting at the University of London Union, London was held in association with diaspora organizations of Kurds, Balochs, Eezham Tamils, Basques, and Sindhis. The Eezham Tamil activists spoke about how the double standards in dealing with the Tamils deployed by the western governments gave a green signal for the GoSL to carry out its genocidal offensive in May 2009.

Tamil civil society warned US officials on LLRC danger prior to Geneva

“The [Sri Lankan] Government’s current activities in the North and East are challenging the very existence of the Tamil people and more time to the GOSL to implement the LLRC’s recommendations will only mean further time for the Government to play havoc in the North and East and subjugate the interests and aspirations of the Tamil people,” said leading Eezham Tamil civil society members in the island, in a letter addressed to the visiting US Under Secretary of State Maria Oetro and the Assistant Secretary of State Robert Blake last month on 10 February 2012. TamilNet has received a copy of this confidential letter and releases it to the public after blacking out the names and other identity of the members for security reasons. The letter clearly outlines the grave danger of initiating the accountability process with the so-called ‘positive recommendations’ of the LLRC report.

US resolution offers bailout to Rajapaksa: Brian Senewiratne

The US-tabled resolution, which has more to do with geopolitics than human rights, “effectively offers Rajapaksa a way of ending international criticism and the danger of government leaders and its Armed Forces facing war crimes charges,” says Brian Senewiratne, a renowned physician and an Australia based Sinhala expatriate in a 41-page long document released on Thursday. “Concerned people, in particular the expatriate Tamil community, waiting for the UN ‘to do something’, are living in a dream world. The UN and its bodies do not act this way. They never have – an abysmal record of failure, which is not about to change.” However, the latest follow-up documentary by the Channel-4 could be even more damaging for the GoSL than the previous one, according to Dr. Brian Senewiratne.

Ram journalism faces criticism in JNU for pro-Sri Lanka bias, endorsing genocide

Activists of Delhi Tamil Students’ Union, Democratic Students Union, Students for Resistance and other common students raised slogans against N. Ram accusing him of being a ‘media fascist’ and ‘a stooge of Rajapaksa’ at a public meeting in JNU after his reply to a question on The Hindu’s role in whitewashing the Sri Lankan state genocide of the Eezham Tamils, wherein he had extensively blamed the LTTE. The meeting on ‘Paid news and media ethics’ was organized at JNU on Wednesday by the Student’s Federation of India, which is the students wing of the CPI(M). The fact that N.Ram and The Hindu have unethically manipulated news to cover up the war crimes of Colombo makes them complicit in the genocide committed on the Eezham Tamils, a Tamil Nadu research scholar in JNU told TamilNet.

Grassroot Diaspora unites, upholds Tamil sovereignty, denounces LLRC-based resolution

A coalition of 12 grassroot Eezham Tamil Diaspora organisations all over the world, on Tuesday, jointly urged the UN Human Rights Council (UNHRC) to compel Colombo to free all Tamils in detention, withdraw all of its armed forces from the Tamil homeland and report back on completion by the 20th session. The organisations, consisting of democratically elected country councils, all the country branches of the Tamil Youth Organisation (TYO) and Tamil Coordinating Committees (TCC) “deeply regretted” the decision of the United States to show regard for the Lessons Learnt and Reconciliation Commission (LLRC) and called upon the UN to initiate an “immediate independent international investigation into the genocide of Eelam Tamils in the island of Sri Lanka” and urged the apex body to conduct a referendum with a free and sovereign state of Tamil Eelam as “an explicit option”.

Tamil plaintiffs to appeal ruling on war crimes case against Rajapakse

Bruce Fein, the attorney for the three Tamil plaintiffs who filed war-crimes charges against Sri Lanka's President Rajapakse, said Saturday that his clients have given consent to file an appeal against the ruling by the District Court of District of Columbia. District Judge Colleen Kollar-Kotelly said in the Court opinion that she had to dismiss the case because the Obama administration had said Rajapakse was immune from litigation as a foreign head of state. The appeal will be heard by a panel of three judges of the U.S. Court of Appeals for the District of Columbia Circuit after the notice of appeal is filed within 30 days of the lower court ruling on the case.

Second generation Eezham Tamils in Canada assert Tamil sovereignty at Youth Conference

Eezham Tamil youth activists from Canada resolved to continue the struggle for Tamil sovereignty at the ‘Eelam Tamil Youth Conference-Canada 2012’ organized by the National Council of Canadian Tamils (NCCT) and the Tamil Youth Organization-Canada (TYO-Canada) at Toronto City Hall, Toronto this Sunday. After three presentations from the organizers and an interactive discussion, nine resolutions were passed in the conference which received unanimous approval from the participants. The resolutions, which welcomed the Tamil Sovereignty Cognition declaration “as a principled approach to resolving the national question of Eelam Tamils”, highlighted the nature of genocide of Eelam Tamils in their homelands. Rejecting the territorial integrity of the unitary Sri Lankan state, the resolutions also called for a boycott of those diaspora organizations that principally lent legitimacy to the same.

Peace academic denounces US-LLRC formula, urges alternative mechanism for justice

“The US support given to UNHRC’s proposal for an accountability mechanism for Sri Lanka would not go beyond requesting GoSL to implement LLRC recommendation which legitimised war to protect the state and reduced human rights violations to the ‘misbehaviour ‘of individual soldiers,” writes Jude Lal Fernando, academic of the Trinity College, Dublin. Establishing what took place was not mere war crimes or crimes against humanity but was intended genocide by Sri Lankan state, and arguing why justice will not come from the powers that conceal the truth and stifle justice and recovery, the academic who was earlier involved in the Dublin Tribunal urges alternative international community to pursue an international independent accountability mechanism.

USA pressurises civil society to accept genocide and to live with it

Two officials from the US State Department who met civil society of Jaffna last week categorically told them that the US would not take up war crimes/ human rights issues against Sri Lanka in the March HRC session, as there is no sufficient pressure or request from the affected people. Ruling out any outside intervention for political solution, the officials said that the US would only support the implementation of the LLRC report, which means annihilation of the nation of Eezham Tamils and completion of structural genocide by 2020, as fixed by the report. The officials didn't listen to the civil group, but insisted only on passing the message. As genocidal Sri Lanka is going to be emboldened further by the stand of the USA and similar stand of India, what responses are going to come from Tamil Nadu and from those who pawned politics to the USA and India, ask the civil groups.

Krishna visit patterns Indo-Sri Lanka deceit on Eezham Tamils

There was no enthusiasm or expectation in Jaffna on the recent visit by India's Foreign Minister S.M. Krishna, media circles said. Civil groups in Jaffna also reflected the same opinion. Just as the visits of MK Narayanan and Shiv Shankar Menon patterned the course of the genocidal war, the visits of the Indian dignitaries in the subsequent phase show a pattern in consolidating the structural genocide of the nation of Eezham Tamils in order to facilitate overlapping interests of India's imperialism and the militarized Sinhala state in the island. Rather than pointlessly expecting India's 'development' help or 'mediation' role, all shades of Tamil polity should firmly demand India to get out, if India's imperialism is incapable of finding any overlapping interest in conceding the right to self determination of the genocide-affected nation of Eezham Tamils, civil circles in Jaffna said.

Internment continues unchecked in Sri Lanka, as an era ends in US

During the final assault in Mu'l'livaaykkaal, Sri Lanka's armed forces herded nearly 300,000 Tamil civilians, including close to 50,000 children and elderly, and LTTE non-combatants, in 21st century version of over-crowded internment camps encircled by barbed wire fences. While GoSL manipulates its demographic politics with the captive internees, in the U.S., an internment era, where 70 years ago more than 100,000 Japanese Americans were interned after the bombing of Pearl Harbor (7th Dec 1941), ended with the death this week of the famous internee, Gordon Hirabayashi, who leaves a legacy that still resonates whenever individual citizens force a Government to live up to its highest and best ideals.

No amnesty for war-criminals, says UN's Navi Pillay

Granting amnesty to perpetrators of war crimes and human rights abuses under Yemen's presidential power transition deal would be against international law, the United Nations human rights chief said on Friday, undermining the peace agreement, Reuters reported. The implications of this to pending litigation of sitting and ex-Presidents in courts around the world are significant according to legal sources in Washington. Professor Francis Boyle commented that while the UN pronouncements were directed towards Yemen, for bringing the culpable Sri Lanka leaders to justice for crimes committed during the Mu'l'livaaykkaal massacre, continued action outside Sri Lanka by Tamil expatriates was crucial.

Colombo Tamil group fallen into GoSL net?

“After the war, with protection of Tamil civilians neutrralized, the Eezham Tamils have become powerless even to conduct their routine day-to-day activities to survive. The occupying Sri Lankan army, the military-led administration of Colombo, and Sri Lankan ministers such as Rishad Bathiutheen, who intervene in the affairs of resettlement, have become the authorities of ‘appeal’ in resettling the Muslims in Jaffna and other places,” says a Colombo-based Tamil academic responding to an appeal that appeared Thursday in the Island paper. The appeal was made by a group of 68 Colombo-based Tamils. The academic describes the move as an attempt to create divisions among the Tamil speaking people and as a move to counter the real civil society in the North and East that has recently spoken up on course correcting the Tamil National Alliance.

Majority ITAK members welcome civil society report, seek course-correction

Majority of the key members of the Ilangkai Thamizh Arasuk Kadchi (ITAK), who met Friday for a central committee meeting at the residence of TNA parliamentary group leader Mr. Rajavarothayam Sampanthan in Trincomalee, have welcomed the recent memorandum submitted by leading members of the Tamil civil society. Calling the TNA leaders to engage with the civil society, the ITAK group sought a course-correction in the process. Two civil society and ITAK senior members, and signatories, Professor emeritus of Archaeology, S.K. Sitrampalam, an ITAK stalwart, and Senior Lecturer at the Department of Hindu Civilisation of Jaffna University, Mrs. Naachiyar Selvanayagam, were present at the committee meeting and explained their concerns of accountability. The meeting resolved that Mr. Sampanthan should engage with the civil society as early as possible in January 2012.

TamilNet releases LTTE documents of 2006 talks

A set of documents prepared by the LTTE’s Peace Secretariat during Geneva peace talks held in February 2006, in June 2006 in Oslo and in October 2006 in Geneva, some of which have not yet reached public domain, are being released by TamilNet to facilitate a deeper understanding of the peace process and its eventual collapse. While 2011 has been a "year of reports," the UN panel report, Norway’s ‘Pawns of Peace’, the genocide model LLRC report etc., the LTTE documents provide valuable insight into the Tigers' efforts undertaken to fulfill LTTE's commitment to the International Community. Though groups such as the International Crisis Group (ICG) reject the application of the concept of "earned sovereignty" to Eezham Tamils, the documents prepared by the Peace Secretariat show how the concept was validated in practice by the LTTE.

LLRC criticisms escalate as Colombo threatens legal action

Questioning the need for "a seven-man presidential Commission costing millions of rupees for platitudinous recommendations that the government will ignore," Prof. Kumar David, in an opinion column in Lakbima says, "[t]his game [LLRC] is not being played for reconciliation with the Tamils; it is being played to get the human rights and international agencies baying for blood off the government’s back," and notes, "[i]f GoSL wants to settle the national question it knows what it needs to do and could have done so a long time ago; no need for commissions. End the military occupation of Tamil areas and close down the High Security Zones, implement full devolution of power, and release Tamil youth held in illegal detention for years. For starters, these few steps will do more than a hundred commissions of inquiry."

Boyle: Tamils safety possible only under separate state

Asserting that the "Tamils on the Island known as “Sri Lanka” have been the victims of genocide as defined by the 1948 Convention on the Prevention and Punishment of the Crime of Genocide," Francis A. Boyle, an expert in International Law, and a professor at the School of Law, University of Illinois, argues using the "remedial sovereignty" doctrine in support, and noting that "[h]istorically the only way a people who have been subjected to genocide like the Tamils on Sri Lanka have been able to protect themselves from further extermination has been the creation of an independent state of their own," and concludes, "[h]ence the need for the Tamils on Sri Lanka to create their own independent state in order to protect themselves from further extermination and total annihilation by Sri Lanka."
